Shipping, Delivery, Collection, Returns and Cancellation Policy

This policy applies to purchases made from Unique Boys (Pty) Ltd through www.uniqueboys.co.za, by quotation or directly through our team.

By placing an order, the customer confirms that they have read and accepted this policy together with our Terms and Conditions. Nothing in this policy is intended to exclude, restrict or replace any rights granted to a consumer under applicable South African law.

2. Delivery Charges

Delivery charges for eligible décor and smaller products will ordinarily be calculated during online checkout after the customer has entered the delivery address.

Certain items—including furniture, oversized products, fragile items, stone, glass, mirrors and custom-made products—do not qualify for standard website shipping. A separate delivery quotation must be requested before these products can be dispatched.

Delivery charges may be calculated according to:

  • The delivery location

  • The dimensions and weight of the order

  • The number of items

  • Packaging or crating requirements

  • Access conditions

  • Specialist handling requirements

  • Installation requirements

  • The delivery service selected

Where delivery is quoted separately, the delivery charge must be accepted and paid before dispatch unless otherwise agreed in writing.

3. Processing and Delivery Estimates

In-stock décor products are generally prepared for dispatch within approximately five to seven business days after payment has cleared.

Estimated delivery after dispatch is generally seven to fourteen business days, depending on the destination and courier service. Remote areas, farms, estates, regional destinations and periods of unusually high demand may require additional time.

Custom-made furniture has a separate manufacturing lead time communicated in the quotation or order confirmation. Manufacturing time and delivery time are separate.

All lead times are estimates unless a specific date has expressly been agreed in writing. Unique Boys will take reasonable steps to deliver within the agreed period or, where no period was agreed, within a reasonable time as required by law.

Delays may occur because of material availability, supplier delays, courier disruption, adverse weather, public holidays, strikes, civil unrest, load-shedding, access restrictions or other circumstances beyond our reasonable control. Where a material delay occurs, we will notify the customer and provide an updated estimate.

Nothing in this section limits a customer’s statutory rights relating to delivery.

4. Dispatch and Tracking

Where tracking is available, the customer will receive tracking information after dispatch.

If an order has not arrived within the estimated delivery period, please contact info@uniqueboys.co.za with:

  • The customer’s full name

  • Order or invoice number

  • Delivery address

  • Contact telephone number

  • Details of the outstanding delivery

We will investigate the delivery with the relevant courier or delivery provider.

5. Delivery Address and Contact Information

The customer is responsible for providing a complete and accurate delivery address, postal code, telephone number and any relevant access instructions.

Unique Boys will not be responsible for additional costs or delays arising from incorrect, incomplete or outdated information supplied by the customer. Any reasonable redelivery, storage or address-correction costs may be charged to the customer where the error was not caused by Unique Boys.

Changes to a delivery address must be requested in writing before dispatch. We cannot guarantee that an address can be changed after an order has entered the delivery process.

6. Risk During Delivery

Where Unique Boys or its appointed delivery provider delivers an order, the goods remain at our risk until the customer, or a person authorised by the customer, accepts delivery, as required by applicable law.

Where the customer appoints and pays an independent carrier or transport provider that is not selected, instructed or controlled by Unique Boys, the legal position may differ. The allocation of risk will be determined by the applicable agreement and South African law.

Nothing in this policy excludes liability where liability cannot lawfully be excluded.

7. Receiving and Inspecting an Order

The customer or authorised recipient must, wherever reasonably possible, inspect the packaging and visible condition of the goods at delivery.

If any visible damage, shortage or incorrect item is identified:

  1. Record the issue on the delivery note before signing.

  2. Take clear photographs of the packaging and product.

  3. Retain all packaging and protective materials.

  4. Notify Unique Boys as soon as reasonably possible at info@uniqueboys.co.za.

  5. Include the order number and photographs.

Signing a delivery note without recording visible damage may make it more difficult to establish when or how the damage occurred. However, signing a delivery note does not remove any statutory rights concerning concealed defects or goods that fail to meet legal quality standards.

The customer must not discard, repair, modify, install or use a reportedly damaged product before Unique Boys has been given a reasonable opportunity to assess it.

8. Packaging

Décor products are wrapped and packaged with reasonable care to reduce the risk of damage during transit.

Furniture, fragile goods, mirrors, glass, stone and oversized items may require specialist wrapping or custom crating. Additional packaging or crating charges will be disclosed in the applicable quotation.

Packaging is intended to protect goods during ordinary handling. Customers must take reasonable care when removing packaging and must not use sharp objects in a manner that may damage fabric, leather, timber or other surfaces.

Damage caused during unpacking by the customer or another person after delivery is not considered transit damage.

9. Furniture Delivery

Furniture does not qualify for ordinary courier shipping unless expressly stated on the product page or confirmed in writing.

A furniture-delivery quotation may be required and will depend on:

  • Product dimensions and weight

  • Delivery destination

  • Stairways, lifts and access routes

  • Labour requirements

  • Specialist equipment

  • Installation requirements

  • Protective wrapping or crating

Unless installation is included in the written quotation, delivery means placing the item at the nearest safe and reasonably accessible location agreed with the customer.

The delivery team is not authorised to perform additional work that was not included in the quotation.

10. Access Requirements

Before ordering, the customer must check that the product will fit:

  • Through gates and entrances

  • Through doorways and passages

  • Around corners

  • Into lifts

  • Up staircases

  • Through security doors

  • Into the intended room or position

The customer must also check ceiling heights, floor loading, wall clearances and any other relevant obstructions.

Product measurements can be supplied to assist the customer, but the customer remains responsible for checking the complete access route and intended installation area unless Unique Boys was expressly contracted to perform a site measurement.

The customer must disclose access conditions before delivery, including:

  • Stairs or narrow passages

  • Lift restrictions

  • Estate or complex access procedures

  • Delivery-hour restrictions

  • Loading-zone restrictions

  • Long carrying distances

  • Gravel roads or difficult terrain

  • Hoisting or specialist equipment requirements

  • Construction work or unsafe site conditions

If delivery cannot reasonably or safely be completed because the product does not fit, access information was not disclosed, the site is unsafe or the customer is unavailable, the goods may be returned to our factory or storage facility.

The customer may be charged reasonable and properly disclosed costs for:

  • The unsuccessful delivery attempt

  • Return transport

  • Storage

  • Redelivery

  • Additional labour

  • Specialist equipment

  • Modification requested by the customer

Any such charge will be subject to applicable law and will not apply where failed delivery was caused by Unique Boys or its appointed delivery provider.

11. Site Readiness

The customer must ensure that the delivery or installation area is clean, safe, accessible and ready before the delivery team arrives.

Unique Boys may postpone delivery or installation if the site presents a reasonable health, safety or damage risk. This includes active construction, exposed electrical work, unsafe stairs, uncontrolled animals, inadequate lighting, blocked access or unsuitable weather conditions.

Reasonable additional costs caused by an unready or unsafe site may be charged to the customer where permitted by law.

12. Delivery Appointments

Furniture deliveries must be scheduled in advance.

The customer must ensure that an authorised adult is present to receive and inspect the goods. If a customer appoints another person to accept delivery, that person will be treated as authorised to receive the order on the customer’s behalf.

Delivery time windows are estimates and may be affected by traffic, weather, access delays and earlier deliveries. Our team will communicate material changes where reasonably possible.

13. Storage and Uncollected Goods

Where goods are ready but the customer delays delivery or collection, Unique Boys may hold the goods for a reasonable initial period.

After written notice, reasonable storage charges may apply if goods are not collected or cannot be delivered because of circumstances attributable to the customer. The applicable charge and commencement date will be communicated in writing.

Unique Boys will deal with uncollected goods only in accordance with applicable South African law. Ownership of paid goods will not automatically be forfeited merely because collection is delayed.

14. Collection

All collections must be arranged and confirmed in advance by contacting info@uniqueboys.co.za.

Customers may not arrive for collection without confirmation that the order is complete, paid and ready.

The person collecting may be required to provide:

  • The order or invoice number

  • Proof of payment

  • Suitable identification

  • Written authority where collecting for another person

The customer is responsible for supplying a suitable vehicle, adequate labour, restraints, blankets and protective materials unless packaging or loading assistance has been agreed in writing.

Our team may refuse to load goods into a vehicle that is visibly unsuitable or where loading would create a reasonable safety risk or a significant likelihood of damage.

The customer or appointed carrier must inspect the goods at collection. Risk passes upon lawful acceptance of collection, subject to the customer’s statutory rights relating to defects and quality.

Unique Boys is not responsible for damage caused after collection by inadequate securing, unsuitable transport, negligent handling or improper storage by the customer or the customer’s carrier.

15. International Orders

International delivery is arranged by quotation only.

Please contact info@uniqueboys.co.za before placing an international order.

Unless expressly stated otherwise in writing:

  • International shipping charges are excluded from product prices.

  • Customs duties, import taxes, clearance fees and destination charges are payable by the customer.

  • Delivery estimates may be affected by customs procedures.

  • The customer is responsible for ensuring that the product may lawfully be imported into the destination country.

  • Additional export packaging or crating may be required.

The applicable delivery terms, insurance and allocation of risk must be recorded in the international shipping quotation.

16. Online Cooling-Off Rights

Where an online transaction qualifies for the cooling-off right under the Electronic Communications and Transactions Act, the customer may cancel the transaction within seven days after receiving the goods, without giving a reason.

Where this statutory right applies:

  • The customer may be responsible for the direct cost of returning the goods.

  • Goods must be returned with all accessories and components.

  • Refunds will be processed within the period required by law.

  • The goods must be reasonably protected while awaiting return.

The statutory online cooling-off right does not ordinarily apply to goods made to the customer’s specifications, clearly personalised goods, goods that by their nature cannot be returned or other categories excluded by law.

This exclusion is particularly relevant to custom-sized, custom-finished, custom-upholstered and otherwise bespoke furniture.

Nothing in this section removes any rights relating to defective, unsafe or incorrectly supplied goods.

17. Custom-Made and Personalised Orders

Custom-made goods are manufactured according to specifications approved by the customer.

Before manufacturing begins, the customer must carefully check and approve:

  • Dimensions

  • Design

  • Timber selection

  • Finish and colour

  • Fabric or leather

  • Orientation

  • Hardware

  • Quantity

  • Other written specifications

Once materials have been ordered or manufacturing has started, a custom order cannot ordinarily be cancelled or changed merely because the customer has changed their mind.

If Unique Boys agrees to a cancellation or change, the customer may be responsible for a reasonable amount reflecting work already performed, materials ordered, special-order components and other actual losses, subject to applicable law.

Custom-made status does not remove the customer’s legal rights where goods are defective, unsafe, materially different from the approved specification or otherwise fail to meet mandatory legal standards.

18. Natural Materials and Reasonable Variations

Solid timber, leather, stone and other natural materials may display variations in grain, colour, markings, texture, knots and tone.

Computer screens, photographs, samples and different lighting conditions may also affect how colours appear.

Reasonable natural variations are not defects where the goods remain consistent with the agreed description, sample and ordinary characteristics of the material.

Handcrafted products may also display minor variations that do not materially affect their appearance, function, safety or durability.

Where an exact colour match is essential, this must be disclosed and agreed in writing before manufacturing begins. Exact matching between different timber boards, leather hides, fabric batches or previously manufactured pieces cannot always be guaranteed.

19. Incorrect, Damaged or Defective Goods

If goods are incorrect, damaged on delivery or potentially defective, the customer must notify Unique Boys as soon as reasonably possible.

Please provide:

  • The order or invoice number

  • A description of the issue

  • Clear photographs or video

  • Photographs of the packaging, where relevant

  • Any other information reasonably required to assess the matter

Unique Boys may arrange an inspection, request that the goods be returned or appoint a qualified person to assess them.

Where goods fail to comply with the statutory warranty of quality, the customer will be entitled to the remedies provided by South African law. Depending on the circumstances, these may include repair, replacement or refund.

Unique Boys is not responsible for damage caused by:

  • Misuse or abuse

  • Negligence or accidental damage after delivery

  • Incorrect assembly by an unauthorised person

  • Unauthorised repairs or alterations

  • Failure to follow care instructions

  • Exposure to excessive sunlight, heat or moisture

  • Normal wear and tear

  • Unsuitable cleaning products

  • Pest infestation

  • Improper storage

  • Damage caused by the customer’s own carrier

These exclusions do not apply where the loss resulted from a defect or circumstance for which Unique Boys remains legally responsible.

20. Change-of-Mind Returns

Except where a statutory cooling-off right applies, Unique Boys is not obliged to accept a return merely because the customer has changed their mind, selected the incorrect size or colour, or no longer wants the product.

Where Unique Boys elects to accept a discretionary return:

  • Prior written approval is required.

  • The product must be unused, unassembled and in resalable condition.

  • Original packaging must be retained where reasonably possible.

  • The customer may be responsible for reasonable collection or return costs.

  • A reasonable deduction may be made for loss in value caused by unnecessary handling or damage.

  • Custom-made, personalised and specially ordered products are excluded unless otherwise required by law.

No discretionary return should be sent before written return instructions have been issued.

21. Order Cancellations

Cancellation requests must be submitted in writing to info@uniqueboys.co.za.

Where the law permits a cancellation charge, Unique Boys may impose a reasonable cancellation charge after considering:

  • The nature of the goods

  • The time remaining before delivery

  • Work already completed

  • Materials already ordered

  • The likelihood of finding another customer

  • The circumstances of the cancellation

  • The actual loss suffered

No cancellation charge will be imposed where prohibited by law.

22. Refunds

Approved refunds will be paid using the original payment method where reasonably possible.

Before processing a refund, Unique Boys may inspect returned goods to confirm their identity, condition and the basis of the return.

Refund processing times may vary according to the payment provider. Any statutory refund will be completed within the period prescribed by law.

Original delivery fees and return costs will be handled according to the reason for the return and applicable law.

23. Limitation of Liability

To the fullest extent permitted by South African law, Unique Boys will not be liable for indirect, incidental or consequential losses that were not reasonably foreseeable when the transaction was concluded.

Unique Boys will not be responsible for delays, failed delivery or additional costs caused by inaccurate customer information, undisclosed access restrictions, an unsafe site, a customer-appointed carrier or circumstances beyond our reasonable control.

This clause does not exclude liability for gross negligence, defective or unsafe goods, breach of a mandatory statutory duty or any other liability that may not lawfully be excluded.

24. Complaints and Disputes

We aim to resolve concerns fairly and promptly.

The parties should first attempt to resolve the matter directly and in good faith. Nothing in this policy prevents a consumer from approaching an appropriate ombud, regulator, tribunal or court where entitled to do so.

25. Changes to This Policy

Unique Boys may update this policy from time to time to reflect operational, legal or regulatory changes.

The policy applicable to an order will ordinarily be the version made available when the order was placed, except where a later change is required by law or is more favourable to the customer.

26. Governing Law

This policy is governed by the laws of the Republic of South Africa.

If any provision is found to be unlawful or unenforceable, that provision will be limited or severed to the minimum extent necessary, without invalidating the remaining provisions.

Nothing in this policy limits any non-excludable rights provided by the Consumer Protection Act, the Electronic Communications and Transactions Act or other applicable South African legislation.

27. Custom-Made Furniture Is Non-Refundable

Custom-made, made-to-order, specially sized, specially finished, personalised or custom-upholstered furniture cannot be returned or refunded because of a change of mind, an incorrect customer measurement, access limitations, a colour preference or any specification approved by the customer. This includes furniture manufactured using a customer’s chosen dimensions, timber, finish, fabric, leather, colour, orientation, hardware or design. Once the order has been approved and manufacturing or material procurement has commenced, all deposits and payments relating to completed work, committed labour and specially ordered materials are non-refundable to the extent permitted by law. This provision does not limit the customer’s statutory rights if the furniture is defective, unsafe, materially different from the approved specification or otherwise fails to meet the mandatory requirements of South African law.
